Judge denies request to stop mosque's construction

BULLETIN: Judge denies request to stop mosque's construction | dnj.com | The Daily News Journal: "Rutherford County Chancellor Robert Corlew III denied plaintiffs a preliminary injunction today to stop the county from issuing more building permits for the Islamic Center of Murfreesboro.

Corlew ruled that plaintiffs Kevin Fisher, Lisa Moore and Henry Golczynski did not show enough evidence on how they were injured by the county’s Regional Planning Commission’s May 24 decision to approve the ICM’s site plan for a 52,960-square-foot community center with a mosque on Veals Road off Bradyville Pike, southeast of Murfreesboro City limits.

The chancellor further said there was not enough evidence to show that the ICM was engaging in any threatening conduct or adhering to Shariah Law even though there are concerns about the associations or conduct of the congregation’s leadership.

Corlew, though, said it’s possible that the county could be challenged by not providing proper public notice about the meeting through it’s legal advertisement May 2 about the May 24 meeting in The Murfreesboro Post. He questioned if the paper qualified as a paper of general circulation.
